PART I — CANDIDATE PRIVACY NOTICE
1. PURPOSE AND SCOPE
Markage is a trade name of Harper Stride Group Ltd. References to “Markage”, “we”, “us”, or “our” mean Harper Stride Group Ltd. Markage is a Canadian business that recruits individuals for employment opportunities located in the United States.
This Candidate Privacy Notice explains how Markage collects, uses, discloses, retains, and protects personal information in connection with U.S. job postings, applications, interviews, candidate communications, and related hiring activities through our careers website, application forms, and supporting software.
This Notice applies when you:
- view or respond to a Markage job posting for a U.S. role;
- begin or complete an application;
- answer role-related application questions;
- provide information concerning qualifications, experience, work authorization, credentials, certifications, or other role requirements;
- upload a résumé or other requested material;
- participate in an interview or other hiring activity;
- check or receive information about application status;
- communicate with Markage concerning employment;
- request an accommodation in connection with the application or interview process; or
- exercise a privacy right concerning application information.
This Notice applies to applications for Markage employment opportunities in the United States. It does not govern personal information collected after an individual becomes an employee or contractor, except where expressly stated.
2. APPLICABLE PRIVACY LAWS
Markage handles candidate personal information in accordance with applicable U.S. federal, state, and local law.
To the extent Markage is subject to the California Consumer Privacy Act, as amended by the California Privacy Rights Act (“CCPA/CPRA”), with respect to a particular applicant, this Notice includes disclosures concerning California resident applicants.
Other state privacy laws may provide additional rights or may contain exemptions for employment-related information. Where applicable law imposes additional requirements concerning applicant information, Markage will comply with those requirements.
Nothing in this Notice limits any right that cannot lawfully be waived.
3. CALIFORNIA NOTICE AT COLLECTION — WHERE APPLICABLE
To the extent required by the CCPA/CPRA, Markage provides this Notice at Collection to California resident applicants.
Categories of personal information we may collect. Depending on the position and stage of the application process, Markage may collect:
- Identifiers, such as name, email address, telephone number, postal address if voluntarily provided, IP address, and application reference information;
- Professional or employment-related information, such as work history, experience, skills, qualifications, credentials, certifications, résumés, and responses to role-related questions;
- Education information, such as schools attended, degrees, qualifications, and other education information relevant to the position;
- Internet or other electronic network activity, including limited technical information generated through use of the careers website and application process and basic website traffic information collected through Google Analytics;
- Audio, electronic, visual, or similar information, if an interview or other hiring interaction is recorded after any required notice or consent; and
- Sensitive personal information only where voluntarily provided or lawfully required for a specific hiring-related purpose, such as accommodation-related information or information concerning lawful authorization to work in the United States.
Markage does not require candidates to provide sensitive information that is unnecessary for the application process.
Categories of sources. Personal information may be collected:
- directly from you through application forms, résumés, interviews, and communications;
- through third-party software used by Markage to receive and administer applications;
- from references you identify or authorize; and
- from publicly available professional sources where permitted by law.
Categories of recipients. Candidate personal information may be disclosed to:
- software and service providers processing information on Markage’s behalf for application administration, hosting, communications, file processing, or related technical functions;
- professional advisers, including legal counsel and auditors, where reasonably necessary;
- background-screening providers where a lawful background check is conducted and all required disclosures and authorizations have been provided; and
- government authorities or other parties where disclosure is required by law or reasonably necessary to protect legal rights, security, or safety.
Purposes of collection and use. Markage may use candidate personal information to:
- receive and administer applications;
- communicate with candidates;
- evaluate qualifications and experience;
- determine whether candidates satisfy legitimate requirements of a position;
- arrange and conduct interviews;
- verify relevant information;
- maintain hiring records;
- provide application-status functionality;
- provide reasonable accommodation;
- operate, measure, troubleshoot, and secure the careers website and application process;
- detect or investigate suspected fraud, misuse, or security incidents;
- comply with legal and recordkeeping obligations; and
- establish, exercise, or defend legal claims.
Markage does not sell candidate application information or use candidate application information for cross-context behavioral advertising.
Retention. Markage retains personal information only for as long as reasonably necessary for the purpose for which it was collected, applicable legal and recordkeeping requirements, security and audit needs, and the establishment, exercise, or defense of legal claims. The following criteria apply by category:
- Identifiers, professional information, education information, résumés, application materials, and hiring records: retained through the hiring process and for the period reasonably necessary afterward to satisfy applicable recordkeeping requirements and address legal claims. For unsuccessful applications, decision-related records are generally retained for at least one year and ordinarily no longer than four years after the applicable hiring decision unless a longer period is required by law or reasonably necessary for a pending matter;
- Internet and electronic network activity, including basic analytics data: retained for the period reasonably necessary to measure website traffic, operate and secure the site, troubleshoot technical issues, investigate misuse, and satisfy applicable legal obligations;
- Audio or visual recordings: if created, retained only for as long as reasonably necessary for the hiring purpose, applicable recordkeeping requirements, and any related legal matter; and
- Sensitive personal information: retained only for as long as reasonably necessary for the lawful purpose for which it was collected and any applicable legal recordkeeping requirement.
Information relating to a successful candidate that becomes necessary for employment may be transferred to appropriate employment records and retained under applicable employee recordkeeping practices.
California privacy rights. Where the CCPA/CPRA applies, California residents may have rights to request access to personal information, correction of inaccurate information, deletion of personal information, and information concerning Markage’s collection, use, and disclosure practices. Where applicable under the CCPA/CPRA, California residents may also have rights concerning sensitive personal information and other rights provided by law.
Candidates may submit privacy requests to legal@markage.ca. Markage may verify the identity of the person making a request and, where applicable, the authority of an authorized agent. Where applicable law requires an additional request method, Markage will make that method available through the relevant website or application process.
Markage will not discriminate or retaliate against a candidate for exercising a privacy right protected by law.
4. INFORMATION WE COLLECT
Markage limits collection to information reasonably necessary for legitimate hiring, legal, security, and operational purposes.
Depending on the position and stage of the application process, this may include:
- name and contact information;
- the position for which you apply;
- responses to role-related questions;
- employment history;
- education;
- skills and qualifications;
- professional licenses, certifications, or credentials;
- whether you are lawfully authorized to work in the United States;
- résumés and other application materials;
- interview information;
- audio or visual information where a hiring interaction is lawfully recorded;
- application status and relevant timestamps; and
- limited technical and analytics information required to operate, measure, and protect the careers website and application process.
Markage does not require candidates to disclose protected characteristics merely to submit an application, except where information is lawfully required or voluntarily provided for a specific lawful purpose, such as an accommodation.
If Markage separately requests voluntary self-identification information for a lawful purpose, that information will be handled in accordance with applicable law and, where appropriate, separately from ordinary qualification evaluation.
5. APPLICATION QUESTIONS AND SOFTWARE ADMINISTRATION
The application may ask questions relevant to the requirements of a particular role. The sequence of questions may change based on information already provided so candidates are not unnecessarily asked for the same information more than once.
Markage uses third-party software to support its careers website and application process. Markage controls the job postings, application questions, candidate communications, review process, and hiring decisions.
Ordinary software functionality may validate required fields, receive and store submitted information, route application information to authorized Markage personnel, and support administrative workflow. It does not determine candidate eligibility, reject applications, rank or score candidates, recommend candidates, or make hiring decisions.
6. ARTIFICIAL INTELLIGENCE
Markage does not use artificial intelligence to screen, rank, score, recommend, or select candidates for employment.
Markage does not use artificial intelligence to make hiring decisions.
Final substantive employment decisions are made by humans. If Markage’s hiring technology or practices materially change in the future, this Notice will be updated and any notices, rights, assessments, or procedures required by applicable law will be implemented as required.
7. U.S. LOCATION AND WORK AUTHORIZATION
Positions covered by this Notice are U.S.-based roles and are intended for individuals who will be based in the United States for the role.
Candidates must be lawfully authorized to work in the United States by the date employment begins. Markage does not provide immigration or employment-visa sponsorship for U.S. roles.
Markage may ask whether a candidate is legally authorized to work in the United States and whether sponsorship would be required. Markage does not require disclosure of citizenship, national origin, or specific immigration documents during the application process except where lawfully required at a later stage.
If an offer is accepted and U.S. law requires employment-eligibility verification, the applicable employer will complete the required Form I-9 process. Candidates will be permitted to present acceptable documentation as provided by law.
8. CREDENTIALS AND VERIFICATION
Certain positions may require or prefer particular credentials, licenses, certifications, education, experience, or equivalent evidence. Markage may verify information provided by a candidate where reasonably necessary and permitted by law.
9. RÉSUMÉS AND UPLOADED FILES
Submitted résumés and other files become part of the application record. Candidates should avoid including sensitive personal information that is unnecessary for the application.
Temporary technical copies created during file processing will not be retained longer than reasonably necessary, subject to security, backup, system integrity, and legal requirements.
10. PURPOSES FOR USE
Markage uses candidate personal information for the hiring purposes described in this Notice and related legal, security, analytics, and operational purposes. Markage will not use candidate information for a materially unrelated purpose without providing any notice or obtaining any consent required by applicable law.
11. HUMAN REVIEW AND EMPLOYMENT DECISIONS
Candidate information assists authorized Markage personnel in evaluating applications. Final substantive selection decisions are made by humans and may consider qualifications, experience, skills, requirements of the position, interview information, credentials, availability, lawful work-authorization requirements, and other legitimate, job-related factors.
Markage does not make employment decisions on grounds prohibited by applicable federal, state, or local anti-discrimination law.
Submission of an application does not guarantee an interview, further consideration, an offer, or employment. Employment, if offered, is generally at will where permitted by applicable law and subject to any applicable statutory, contractual, or jurisdiction-specific exceptions.
12. ACCOMMODATION AND ACCESSIBILITY
Candidates who require reasonable accommodation in connection with the application or interview process may contact legal@markage.ca.
Markage will provide reasonable accommodation where required by applicable law unless doing so would impose an undue hardship as defined by applicable law.
If a candidate encounters an accessibility barrier affecting the application process, Markage will work with the candidate to provide a reasonable alternative method of participating in the hiring process where required.
Accommodation-related information will be handled separately from ordinary qualification evaluation where reasonably practicable and as required by law.
13. THIRD-PARTY SOFTWARE, SERVICE PROVIDERS, AND ANALYTICS
Markage may use third-party software and service providers to support application forms, file handling, communications, hosting, and related technical functions. These providers may process candidate information on Markage’s behalf for the services they provide.
Markage controls the content of its job postings, the questions asked in its application process, candidate evaluation, candidate communications, and hiring decisions.
Markage uses Google Analytics for basic website traffic measurement and site-usage analytics. Markage does not use Google Analytics for recruitment advertising, retargeting, candidate scoring, or hiring decisions, and does not intentionally use Google Analytics to collect the substantive contents of applications, résumés, or interview responses.
Markage does not disclose candidate application information to third parties for their independent unrelated marketing purposes.
14. CANADA AND CROSS-BORDER PROCESSING
Markage operates in Canada and recruits individuals for employment opportunities located in the United States. Candidate personal information may therefore be transferred to, stored in, accessed from, or otherwise processed in Canada as part of Markage’s hiring operations.
Candidate information may also be processed in other countries where authorized software or service providers operate. Information processed outside the state or country where a candidate resides may be subject to the laws of the jurisdiction in which it is processed.
Markage applies safeguards appropriate to the nature and sensitivity of the information and applicable legal requirements.
15. SECURITY
Markage maintains administrative, technical, and organizational safeguards appropriate to the nature of candidate information and the risks associated with the careers website and application process. No electronic system can guarantee absolute security.
If a security incident occurs, Markage will take investigation, remediation, and notification measures required by applicable law.
16. RETENTION
Markage retains hiring information only for as long as reasonably necessary for administration of the hiring process, applicable federal, state, and local recordkeeping obligations, legitimate audit and security requirements, responding to disputes or claims, and establishing, exercising, or defending legal rights.
For unsuccessful candidates, decision-related hiring records are generally retained for at least one year and ordinarily no longer than four years after the applicable hiring decision unless a longer retention period is required by law or reasonably necessary because of litigation, an investigation, an audit, a security matter, or another legal obligation.
For successful candidates, information required for employment may be transferred into applicable employment records and handled under the recordkeeping and privacy requirements applicable to those records. California-specific category retention information is provided in Section 3 where applicable.
17. ACCESS, CORRECTION, AND DELETION
Candidates may contact Markage concerning access to, correction of, or deletion of personal information relating to their application. Requests should be submitted to legal@markage.ca.
The availability and scope of a particular right depend on applicable law. Markage may verify identity before processing a request. Deletion is not absolute where Markage is legally permitted or required to retain information, including for employment recordkeeping, security, fraud prevention, legal claims, audits, or regulatory obligations.
18. NON-RETALIATION
Markage will not retaliate against a candidate for exercising a right protected by applicable law. This includes, where protected by applicable law, exercising privacy rights, requesting a reasonable accommodation, reporting suspected unlawful conduct, filing or participating in a lawful administrative complaint or investigation, or otherwise exercising protected employment rights.
19. CHANGES TO THIS NOTICE
Markage may update this Notice when its hiring practices, technology, or legal obligations change. The current version will display its effective date and last-updated date. Where additional notice, consent, or another procedure is required by applicable law, Markage will provide it.
PART II — CANDIDATE TERMS OF USE
20. ACCEPTANCE
By checking the box indicating that you agree to these Terms and then submitting your application, you agree to comply with these Terms. These Terms govern use of Markage’s careers website and application process. The Candidate Privacy Notice in Part I describes how Markage handles candidate personal information.
Acceptance of these Terms does not waive any statutory or other right that cannot lawfully be waived.
21. PURPOSE OF THE CAREERS AND APPLICATION PROCESS
Markage’s careers website and application process allow individuals to review U.S. employment opportunities, provide role-related information, submit applications, and use related hiring functionality.
The careers website and application process are not an employment contract. Their use does not create an employment relationship, promise an interview, or guarantee an offer of employment.
22. ELIGIBILITY
Eligibility for a position is governed by the requirements stated in the applicable job posting and by applicable law. Positions covered by this document are U.S.-based roles. Candidates must be lawfully authorized to work in the United States by the date employment begins, and Markage does not provide immigration or employment-visa sponsorship for U.S. roles.
23. ACCURACY OF INFORMATION
Candidates should provide information that is accurate to the best of their knowledge. Candidates must not knowingly impersonate another person, falsify credentials, submit fraudulent material, or make materially false statements concerning qualifications or requirements of a position.
24. PERMITTED USE
The careers website and application process may be used only for legitimate employment-application purposes. Candidates must not attempt unauthorized access, introduce malicious code, intentionally interfere with operation of the site or application process, scrape or extract data without authorization, or use the service for an unlawful purpose. Legitimate use of assistive technology is permitted.
25. APPLICATION PROCESS AND CORRECTIONS
The sequence of application questions may vary based on the position and information already provided. Candidates should review submitted information for accuracy before final submission.
Once submitted, an application becomes part of Markage’s hiring records. The ability to change information after submission may depend on the stage of the process and applicable recordkeeping requirements. If a material error is discovered after submission, contact legal@markage.ca.
26. NO GUARANTEE OF EMPLOYMENT
A job posting, application, application-status message, interview invitation, or other activity through Markage’s careers website or application process does not constitute an offer of employment. An employment offer exists only when an authorized offer is issued in the form required by applicable law.
27. JOB-POSTING DISCLOSURES AND SALARY HISTORY
Where applicable law requires disclosure of a pay range, benefits information, or other information in a publicly advertised position, Markage will provide the information required by that law. Markage will not seek or rely on salary-history information where applicable law prohibits the inquiry or use.
28. BACKGROUND CHECKS AND FAIR-CHANCE COMPLIANCE
If Markage or the applicable employer obtains an employment background report from a consumer-reporting agency, the process will comply with the Fair Credit Reporting Act and applicable state and local law.
Where the Fair Credit Reporting Act applies, the required stand-alone disclosure will be provided and the required written authorization obtained before the report is requested. If adverse action is considered based on information in a covered consumer report, the notices, report copy, Summary of Rights, and other procedures required before and after adverse action will be provided.
Applicable fair-chance, ban-the-box, timing, notice, and individualized-assessment requirements will also be followed. Acceptance of these Terms does not constitute authorization for a background check.
29. RECORDED INTERVIEWS AND REGULATED TECHNOLOGY
If Markage records an interview or other hiring interaction in audio or video form, Markage will provide any separate notice or obtain any separate consent required by applicable law before recording begins. Acceptance of the general Terms of Use does not replace any separate recording consent required by law.
If a hiring technology processes biometric or similarly regulated information, Markage will provide any additional notice, consent, retention information, or procedure required by applicable law before that processing occurs.
30. AVAILABILITY AND INTELLECTUAL PROPERTY
Markage may modify, suspend, or discontinue careers-site or application functionality for maintenance, security, legal, technical, or operational reasons. Markage does not guarantee uninterrupted availability.
Markage’s original site content is protected by applicable intellectual-property law. Candidates receive a limited right to use the careers website and application functionality for their intended purpose.
Candidates retain applicable rights in their own submitted materials. Submission grants Markage the limited rights reasonably necessary to receive, store, review, process, verify, and otherwise administer the application.
31. LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, Markage is not liable for indirect, incidental, special, consequential, or punitive damages arising solely from use of or inability to use the careers website or application functionality.
Nothing in these Terms excludes or limits any right, remedy, liability, or obligation that cannot lawfully be excluded or limited, including applicable employment, anti-discrimination, privacy, accessibility, consumer-reporting, or other statutory protections.
32. SECURITY AND RESTRICTION OF ACCESS
Markage may restrict access where reasonably necessary to address security threats, fraud, unauthorized access, unlawful activity, or material misuse. Restriction of access does not relieve Markage of applicable legal obligations concerning information already under its control.
33. CHANGES TO THESE TERMS
Markage may update these Terms for future use of the careers website and application process. The version presented when a candidate proceeds with an application will govern that use, subject to applicable mandatory law. A later update will not retroactively remove rights that applied when an earlier application was submitted.
34. APPLICABLE LAW AND MANDATORY RIGHTS
These Terms will be interpreted and enforced in accordance with applicable law. Nothing in these Terms limits any mandatory employment, privacy, anti-discrimination, accessibility, consumer-reporting, immigration-related employment, or other non-waivable protection applicable because of the candidate’s location, the location of the position, Markage’s operations, the applicable employer, or another jurisdiction with legally applicable authority over the hiring activity.
35. SEVERABILITY AND NO WAIVER
If a provision of these Terms is found unenforceable, it will be limited to the extent necessary to address the unenforceability, and the remaining provisions will continue in effect. Failure to enforce a provision on one occasion does not waive the right to enforce it later.
36. ENTIRE AGREEMENT
These Terms and the Candidate Privacy Notice constitute the agreement concerning use of Markage’s careers website and application process unless a separate written agreement expressly modifies them. They do not replace any employment agreement or other employment document that may later be entered into.
